Conditions Applying to This Site and to Equipment We Supply


Who We Are

This site is operated by Southwest Thermal Technology Inc. It presents Bell & Gossett shell and tube heat exchangers and tank heater bundles, together with reference material on their construction, ratings and applications. Using the site means these conditions apply to you.

Changes to These Conditions

We may revise these conditions from time to time. The version published here is the one in force. Continuing to use the site after a revision means the revised conditions apply to you, so it is worth checking the date at the foot of this page if you rely on them.

Quotations and Orders

Quotations are valid for the period stated on the quotation and are subject to material availability at the time an order is placed. Prices are based on the process conditions, materials, code requirements and documentation stated in the quotation. Where any of those change after order, price and delivery may change with them. Orders are accepted subject to these conditions, and terms in a purchase order that conflict with them apply only where we have agreed to them in writing.

Selection and Performance Information

Equipment is selected against the process conditions the purchaser supplies. Where information is incomplete we will state the assumptions used, and those assumptions form part of the basis of the selection. Performance commitments apply at the stated design conditions. Operation outside them, including flow rates, temperatures, pressures, fluid compositions and fouling beyond the specified allowance, falls outside the performance basis.

Accuracy of Site Content

Dimensions, ratings, materials and application notes on this site are published in good faith as general reference. Catalogued products change, and a given unit may have been built to a superseded specification. Nothing on this site should be treated as a substitute for a written quotation or for the data report supplied with a specific unit. Confirm anything you intend to design around.

Codes, Registration and Jurisdiction

Where a duty requires ASME code construction, a National Board registration, a Canadian Registration Number or double-wall construction for potable water service, those requirements are determined by the jurisdiction and by the authority having jurisdiction rather than by us. We will advise what is available and supply what is ordered, but confirming the requirement that applies to your installation remains with the purchaser.

Delivery

Delivery dates are estimates given in good faith based on conditions at the time of order acknowledgement. Where a jurisdictional registration is required and the model is not already registered in the destination province or state, the timescale of the registering authority is outside our control and is excluded from any delivery commitment. Delivery terms and the point at which risk transfers are as stated on the order acknowledgement.

Intellectual Property

The text, images, diagrams and layout of this site are our property or are used with permission, and are protected by copyright. You may view and print pages for your own use in evaluating or specifying equipment. Reproducing, republishing or redistributing material from this site for other purposes requires our written permission. Bell & Gossett and other manufacturer names and marks referred to on this site remain the property of their respective owners.

Warranty

Equipment is warranted as set out on the applicable order acknowledgement and summarised on our warranty page. Except as stated there, we give no other warranty, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

Limitation of Liability

Our liability is limited to the remedies stated in the warranty. We are not liable for loss of production, loss of profit, cost of removal or reinstallation, or other indirect or consequential loss, however arising. Nothing in these conditions limits liability where it cannot lawfully be limited.

Payment

Payment terms are as stated on the order acknowledgement. Title to equipment passes on receipt of payment in full.

Governing Law

These conditions are governed by the laws of the State of California, and the courts of that state have jurisdiction over any dispute arising from them or from equipment supplied under them.

These conditions apply to quotations, orders and use of this site. Where a written agreement covers a particular order, that agreement takes precedence.
